1. Acceptance of Terms
By accessing or using ParkShare ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
ParkShare is a platform that connects driveway owners ("Hosts") with drivers ("Guests") looking for parking. We facilitate the listing, discovery, and booking of private parking spaces in Melbourne, Australia.
3. Eligibility
You must be at least 18 years old and a resident of Australia to use ParkShare. By creating an account, you represent that you meet these requirements.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities under your account.
- You must provide accurate and complete information when creating an account.
- You must notify us immediately of any unauthorised use of your account.
5. Listings and Bookings
For Hosts:
- You must have the legal right to list the parking space.
- Listing information must be accurate, including location, availability, and pricing.
- You are responsible for ensuring your driveway is safe and accessible.
For Guests:
- You agree to use parking spaces respectfully and only for the booked period.
- You are responsible for any damage caused to the property during your booking.
- Where a listing asks for a security deposit, your card is kept on file and the Host can claim up to the deposit amount within 72 hours after your booking ends. ParkShare reviews each claim and charges your card only for the amount it upholds. Hosts receive the full amount of an upheld claim.
6. Payments
- Payments are processed securely through Stripe. Your card details are entered at checkout and are never stored on ParkShare.
- Hosts receive 100% of the listed spot price. A service fee of 10% of the spot price plus $0.40 is charged to the Guest on top and shown at checkout.
- For bookings made more than 24 hours in advance, your card is saved and verified at booking time and charged 24 hours before your booking starts. Bookings made within 24 hours of the start time are charged immediately.
- If a scheduled payment fails, we will retry for approximately 2 hours. If it still fails, the booking is cancelled, the spot is released, and nothing is charged.
- Hosts receive payments directly to their nominated bank account.
- All prices are in Australian Dollars (AUD).
7. Cancellations
- Either party may cancel 24 hours or more before the booking starts at no cost. If the booking has not yet been charged, nothing is ever charged; if it was charged, the Guest is refunded in full, including the service fee.
- If the Guest cancels within 24 hours of the start time, or after the booking has started, whole unused 24-hour periods of the spot price (measured from the booking start time) are refunded; days already started are not refunded, and the service fee is not refunded.
- If the Host cancels within 24 hours of the start time, or after the booking has started, the Guest is refunded the unused portion (same whole-day rule) plus the full service fee. The Host is charged a late-cancellation fee equal to the booking's service fee, deducted from pending earnings, and listings are hidden while the balance is negative. A strike is recorded against the Host for each late cancellation and for each Guest report of an unusable spot that ParkShare upholds; repeated strikes may result in suspension at ParkShare's discretion.
- Refunds are issued to the original payment method, typically within 3–5 business days.
- Disputes are handled through the in-app report function.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose.
- List spaces you do not have the right to rent.
- Provide false or misleading information.
- Harass, abuse, or harm other users.
- Attempt to circumvent payment through the platform.
9. Limitation of Liability
ParkShare acts as a marketplace connecting Hosts and Guests. We are not responsible for the condition of parking spaces, the conduct of users, or any disputes between parties. The Service is provided "as is" without warranties of any kind.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through your account settings.
11. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
